1. Domain Ownership.

2. General Conditions

2.1 Governing Relationship
These general conditions govern the relationship between the Customer and Madeira Adventure Kingdom.

2.2 Trademark and Billing
Madeira Adventure Kingdom is a registered trademark with INPI. All transactions and billing will be conducted under our legal name: Rodrigues & Cro, Unipessoal, LDA, with VAT number PT511285167.

2.3 Acceptance of Conditions
Registration for any activity implies acknowledgment and acceptance of these conditions.

2.4 Insurance Coverage
Madeira Adventure Kingdom provides third-party liability insurance and personal accident insurance in accordance with Article 46 of Regional Legislative Decree Nº 30/2008/M, dated August 12, 2008. All participants are insured under Madeira Adventure Kingdom’s policies in compliance with Portuguese law. The inherent risks of participating in tourist activities are covered by a personal accident policy and a liability policy, as stipulated by the legislation, with the following coverage:

  • Payment of treatment costs, including hospitalization and medication, up to an annual amount of €3,700.
  • Payment of a capital sum of €20,000 in the event of death or permanent disability of customers, with the death benefit reduced by funeral expenses for customers under 14 years old.
  • The liability insurance provides coverage up to €50,000 per claim, guaranteeing compensation for damages caused by accidents occurring within the policy period, provided claims are made within one year after the contract termination.

Note: Madeira Adventure Kingdom cannot cover expenses exceeding these amounts. If you wish to engage in activities with coverage beyond these limits or for risks not included in the insurance policy, you must arrange additional insurance independently.

2.5 Licensing
Madeira Adventure Kingdom holds the RNAAT 4034 license as a tour operator and the RNAAT 927/2017 license as a tourist entertainment company. Both licenses are issued by the Regional Tourism Direction and Turismo de Portugal, authorizing the activities conducted by Madeira Adventure Kingdom.

2.6 Pricing and Invoicing
The price displayed for each activity includes taxes and all necessary equipment. If you require a personalized invoice, please request it within 72 hours after making your reservation and provide all necessary details. If no request for a personalized invoice is made, an invoice will be issued to “final consumer” according to Portuguese law.

2.7 Reservation Process
To make a reservation, click the “Book Now” button on our official website. You will then be guided through the reservation process by our booking system, FareHarbor. The FareHarbor platform allows secure payments using credit card, Google Pay, iDeal, or Sofort. All payments are encrypted to ensure security.

  • Trip Protection: If you select “yes” for Trip Protection, you can reschedule your booking for any reason up to 60 minutes before the start time. In case of cancellation, you will be reimbursed for the full amount of each ticket, minus the cost of Trip Protection and processing fees.

2.8 Customer Responsibility
It is the responsibility of the customer to ensure they are in good health and fit to participate in the activities. Madeira Adventure Kingdom is not responsible for accidents resulting from carelessness or disrespect of the participants.

2.9 Cancellation Policy
We acknowledge that plans may change unexpectedly. Therefore, we offer flexibility for changes or cancellations. To receive a full refund or change your booking, you must cancel or change your booking more than 24 hours prior to the scheduled activity. No-shows will be charged in full.

2.10 Activity Changes and Cancellations
Activities and tours may be canceled or changed under the following circumstances:

  • The minimum number of participants is not met.
  • Adverse weather conditions occur. (If possible, an alternative tour will be provided.)
  • Minimum safety conditions are not satisfied.
  • Unforeseen circumstances beyond our control, such as collapses, landslides, wars, or conflicts.
  • Agreed conditions between the parties are not fulfilled.
  • The professional guide determines that you do not have the required physical and mental condition to safely participate in the tour or experience. The guide’s decision is final and prioritizes your safety.
  • The professional guide determines that you do not have proper equipment.

2.11 Customer Behavior
The customer is responsible for their individual behavior during each activity. If a customer endangers the safety of others, they may be prohibited from continuing the activity.

2.12 Responsibility for Accidents
Madeira Adventure Kingdom is not responsible for accidents resulting from the negligence or disregard of participants in following the instructions provided by monitors.

2.13 Personal Belongings
Personal belongings are the responsibility of their owners. Madeira Adventure Kingdom is not liable for any objects lost during the activity.

2.14 Use of Audiovisual Material
Customers grant Madeira Adventure Kingdom all rights to the audiovisual material collected during the activity and permit its use for promotional purposes.

2.15 Third-Party Activities
Excursions, Whale and Dolphin Watching, Catamaran trips, and Jeep Safaris are conducted by local suppliers. Madeira Adventure Kingdom acts solely as an intermediary for these activities.

3. General Conditions in our Canyoning Tours

3.1 Compliance with Instructions
All participants must fully comply with the instructions given by the canyoning guides at the beginning of the activity, including the correct use of all individual safety equipment.

3.2 Prohibited Substances
Individuals under the influence of alcohol, drugs, or any other substances that may impair perception, physical dexterity, or behavior will not be permitted to participate in the canyoning tour.

3.3 Health Disclosure
Participants must inform the guides and organization of any relevant health issues. We do not recommend canyoning for individuals with heart problems, knee issues, severe back problems, epilepsy, or any other conditions that may compromise safety.

3.4 Physical and Mental Condition
Clients must ensure they are in good physical and mental condition to participate in the activity.

3.5 Personal Information
We require the following information from all clients for insurance and equipment purposes: full name, date of birth, weight, height, and shoe size. This data is managed confidentially and deleted after the tour.

3.6 First Aid Preparedness
All our guides carry a first aid kit and are trained in first aid rescue.

3.7 Adherence to Safety Rules
Participants who do not respect the instructions and safety rules provided by the organization may be prevented from continuing the tour.

3.8 Canyoning Levels

  • Level 1: No previous experience required, but good physical condition is needed for walking on rocks and rappelling down small waterfalls.
  • Level 2: Prior canyoning experience or familiarity with physical sports is required.
  • Level 3: Previous experience at a similar level is required, with the ability to rappel down 60-meter waterfalls.
  • Level 4: Extensive experience is required, along with excellent physical condition for spending 3-4 hours in a river. Technical questions may be asked to assess suitability.

3.9 Accurate Information
Providing false information or ignoring questions about your condition will absolve Madeira Adventure Kingdom of responsibility for any resulting accidents.

3.10 Age and Physical Requirements

  • Minimum Age: 9 years old or 125cm and 25kg.
  • Maximum Age: 65 years old, provided the individual is in good physical condition and has good mobility. For seniors with good mobility, Level 1 canyoning is recommended.
  • Maximum Weight: 115kg, with a minimum height of 180cm to ensure proper fit of the canyoning suit.

3.11 Photographs
During the tour, we will take photographs and provide clients with a copy for free. These photos are stored for 3 months, after which they are deleted. Clients consent to the use of these photos for promotional purposes on our social media channels or website.

3.12 Personal Belongings
Personal belongings are the responsibility of their owners. Madeira Adventure Kingdom is not liable for lost items during the activity.

3.13 Transportation
Transportation is included in the canyoning tours. Free pick-up is available for hotels in Funchal or Caniço, depending on your accommodation location.

3.14 Required Items
Participants need to bring a towel and swimwear. During winter, bring a jacket or layers to protect against wind and rain before getting into the wetsuit.

3.15 Cancellations and Rescheduling

  • If a tour is canceled due to weather conditions or other circumstances, clients will receive a full refund or credit. These conditions apply only to direct bookings with us.
  • For bookings made through other platforms like GetYourGuide, Viator, or other tour operators, refund requests must be handled directly with them.
  • Rescheduling can be done with 24 hours’ notice (only one reschedule is allowed). If rescheduled, no refunds will be issued.

4. General Conditions in our Hiking Tours

4.1 Compliance with Instructions
All participants must fully comply with the instructions given by the hiking guides at the beginning of the activity, as well as adhere to safety guidelines throughout the tour.

4.2 Prohibited Substances
Individuals under the influence of alcohol, drugs, or any other substances that may impair perception, physical dexterity, or behavior will not be permitted to participate in the hiking tour.

4.3 Health Disclosure
Participants must inform the guides and organization of any relevant health issues. We do not recommend hiking for individuals with heart problems, knee issues, severe back problems, epilepsy, or any other conditions that may compromise safety.

4.4 Physical and Mental Condition
Clients must ensure they are in good physical and mental condition to participate in the activity.

4.5 First Aid Preparedness
All our guides carry a first aid kit and are trained in first aid rescue.

4.6 Adherence to Safety Rules
Participants who do not respect the instructions and safety rules provided by the organization may be prevented from continuing the tour. The decision of the guide is mandatory and final.

4.7 Appropriate Gear
Participants must wear appropriate clothing and footwear suitable for hiking. We recommend mountain boots or sporty shoes with good grip. Participants should bring a hat, sunscreen, water, and any personal medication required. Be prepared for sudden weather changes.

4.8 Personal Belongings
Personal belongings are the responsibility of their owners. The company is not liable for lost items during the activity.

4.9 Weather Conditions
The company reserves the right to cancel or modify the tour in case of adverse weather conditions. Participants will be informed as soon as possible and provided with alternative options or a full refund if necessary.

4.10 Special Condition for the Highest Peaks of Madeira
If you book a tour for hiking from Pico do Areeiro to Pico Ruivo, please note that this hike is always affected by different weather conditions. If it is impossible to safely conduct this hike, we will provide an alternative hike (usually Vereda do Larano or Ponta de São Lourenço due to different weather exposure). If you do not wish to take the alternative route, you must inform the guide.

4.11 Environmental Responsibility
Participants are expected to respect the natural environment. Littering, damaging plants, and disturbing wildlife are strictly prohibited.

4.12 Minimum Age
The minimum age for participation in a hiking tour is 9 years old. Younger children may be allowed on certain tours at the discretion of the company and with prior arrangement.

4.13 Maximum Group Size
To ensure safety and quality, the company may limit the number of participants in each hiking group. Early booking is recommended. We work with a maximum of 15 participants per guide.

4.14 Photographs
During the tour, we may take photographs for promotional purposes. Participants consent to the use of these photos on our social media channels and website.

4.15 Transportation
Transportation to and from the hiking location may be included in the tour package. We offer pick-up services for customers in Machico, Caniço, and Funchal. Details will be provided at the time of booking by our office team.

4.16 Recommended Items
Participants should bring a backpack, water bottle, and any personal snacks. Depending on the season and weather conditions, additional items such as rain gear or extra layers may be necessary.

4.17 Cancellations and Rescheduling

  • If a tour is canceled by the company due to weather conditions or other unforeseen circumstances, clients will receive a full refund or credit.
  • Clients may cancel or reschedule their booking with at least 24 hours’ notice. Rescheduling is subject to availability, and only one reschedule is allowed. If rescheduled, no refunds will be issued.

4.18 Liability
While the company takes all reasonable measures to ensure the safety of participants, hiking activities inherently carry certain risks. Participants acknowledge and accept these risks and agree that the company is not liable for injuries, accidents, or losses that may occur during the tour.

4.19 Agreement to Terms
By booking a hiking tour with us, participants agree to comply with these general conditions and any additional instructions provided by the guides.
